1. Account Creation

You may need to create an account to access certain products or features on the site. You agree to provide accurate and complete information during the registration process. The user is also responsible for maintaining the confidentiality of their account password, and for any activities that occur under their account.

2. License to Use Sound Effects

Upon downloading sound effects or music from the site, you are granted a non-exclusive, worldwide, royalty-free, revocable license to use the sound effects in accordance with the following terms.

2.1 Permitted Uses:

• Add to any Short film, YouTube video, School/University project, presentation, website, animation, podcast, video game or other social media videos (Facebook, TikTok, etc.).
• Educational purposes such as training videos, or integration into e-learning platforms.
• Use them as part of any Theatre performance, Museum, Art Gallery, Theme Park or other live shows and attractions.
• Commercial use such as: TV shows, Movies, advertisements, Radio and Music production.

2.2 Prohibited Uses:

• Distributing or reselling through a separate sounds effects directory, library, YouTube channel, or mobile application.
• Repurposing or editing sounds for resale as ringtones or text message alerts.
• Creating an audio CD or USB drive with our sounds for the purpose of re-sale.

2.3 Credit

In return, you must credit or link to the Sound Effects Factory website or YouTube channel in your project or movie credits.

3. Intellectual Property

All content on the site is the property of Sound Effects Factory or our licensors and is protected by copyright laws. You may not use or imitate our brand name, likeness, unique sound titles, or images without our prior permission or written consent.

5. Limitation of Liability

To the fullest extent permitted by Canadian law, Sound Effects Factory shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from audio files uploaded or distributed on the site, or relating to your access to or use of (or inability to access or use) our site and services.

6. Copyright Claims

Although we are not subject to United States law, we voluntarily comply with the Digital Millennium Copyright Act. If you believe that any of your copyrighted material is being infringed on the service, notifications should be e-mailed to soundeffectsfactory@gmail.com

All notifications not relevant to us or ineffective under the law will receive no response or action. An effective notification of claimed infringement must be a written communication to our agent that includes the following:

• Identification of the copyrighted work that is believed to be infringed. Please describe the work and, where possible, include a copy or the location (e.g., a URL) of an authorized version of the work;
• Identification of the material that is believed to be infringing and its location or, for search results, identification of the reference or link to material or activity claimed to be infringing. Please describe the material and provide a URL or any other pertinent information that will allow us to locate the material on the service or on the Internet;
• Information that will allow us to contact you, including your address, telephone number and, if available, your email address;
• A statement that you have a good faith belief that the use of the material complained of is not authorized by you, your agent or the law;
• A statement that the information in the notification is accurate and that under penalty of perjury that you are the owner or are authorized to act on behalf of the owner of the work that is allegedly infringed; and
• A physical or electronic signature from the copyright holder or an authorized representative.

7. User Conduct

Users are strictly prohibited from engaging in any illegal activities, or using the site in such a way that is prohibited by applicable domestic or foreign laws. This includes attempts to compromise or disable the availability, or security of our site or services, consisting of but not limited to:

DDoS Attacks: Users must not initiate, assist, or participate in any related distributed denial of service (DDoS) attack against our site or services.

Malicious Software: Users must not distribute or deploy any malware, bots, or other software designed to disable or impair our site or services.

Hacking Attempts: Unauthorized access, use, or modification of our systems or database, or any attempt to do so.

Any user found to be in violation may face immediate termination of their account and/or access to our services without prior notice. Additionally, we reserve the right to pursue legal action against individuals or entities that initiate or facilitate the aforementioned illegal activities.
